Oak Grove Smoke House, Inc., 698 F.2d 786 (5th Cir. 1983) <\/span><\/span><script type=\"text\/javascript\"> jQuery('#footnote_plugin_tooltip_735_1_5').tooltip({ tip: '#footnote_plugin_tooltip_text_735_1_5', tipClass: 'footnote_tooltip', effect: 'fade', predelay: 0, fadeInSpeed: 200, delay: 400, fadeOutSpeed: 200, position: 'top center', relative: true, offset: [-7, 0], });<\/script> \u00a0\u00a0Interestingly, the laws and requirements for a trademark depend upon which category the trademark falls within.\u00a0 Generally, if a mark is classified as arbitrary\/fanciful or suggestive, then it is considered to be inherently distinctive and rights are determined by priority of use.\u00a0 If a mark is classified as descriptive, then rights may be determined if it has acquired a secondary meaning. If a mark is classified as generic, no rights are conferred.<\/p>\n\n\n\n<p>Secondary meaning is when the public understands the mark to mean something beyond the words and\/or images of the mark.&nbsp; A good test in analyzing secondary meaning is whether the source of the mark rather than the product itself has acquired a meaning.<\/p>\n\n\n\n<p>A product or service name may become generic over time.&nbsp; Companies many times face a hard struggle to promote their product or name.&nbsp; However, if the name becomes too popular, then they face the struggle of the mark becoming \u201cgenericized.\u201d<span class=\"footnote_referrer\"><a role=\"button\" tabindex=\"0\" onclick=\"footnote_moveToReference_735_1('footnote_plugin_reference_735_1_6');\" onkeypress=\"footnote_moveToReference_735_1('footnote_plugin_reference_735_1_6');\" ><sup id=\"footnote_plugin_tooltip_735_1_6\" class=\"footnote_plugin_tooltip_text\">[6]<\/sup><\/a><span id=\"footnote_plugin_tooltip_text_735_1_6\" class=\"footnote_tooltip\">This is also sometimes called \u201cgenericity.\u201d<\/span><\/span><script type=\"text\/javascript\"> jQuery('#footnote_plugin_tooltip_735_1_6').tooltip({ tip: '#footnote_plugin_tooltip_text_735_1_6', tipClass: 'footnote_tooltip', effect: 'fade', predelay: 0, fadeInSpeed: 200, delay: 400, fadeOutSpeed: 200, position: 'top center', relative: true, offset: [-7, 0], });<\/script> &nbsp;&nbsp;For example, the terms aspirin, linoleum, thermos, videotape, and zipper all had valid trademarks at one time, but because the term came to represent or describe a general category (rather than a specific product), the mark became generic.<\/p>\n\n\n\n<p>Rights to a trademark may be acquired either by being the first to use the mark in commerce or by being the first to register the mark with the USPTO.<span class=\"footnote_referrer\"><a role=\"button\" tabindex=\"0\" onclick=\"footnote_moveToReference_735_1('footnote_plugin_reference_735_1_7');\" onkeypress=\"footnote_moveToReference_735_1('footnote_plugin_reference_735_1_7');\" ><sup id=\"footnote_plugin_tooltip_735_1_7\" class=\"footnote_plugin_tooltip_text\">[7]<\/sup><\/a><span id=\"footnote_plugin_tooltip_text_735_1_7\" class=\"footnote_tooltip\">See 15 U.S.C. \u00a7 1127<\/span><\/span><script type=\"text\/javascript\"> jQuery('#footnote_plugin_tooltip_735_1_7').tooltip({ tip: '#footnote_plugin_tooltip_text_735_1_7', tipClass: 'footnote_tooltip', effect: 'fade', predelay: 0, fadeInSpeed: 200, delay: 400, fadeOutSpeed: 200, position: 'top center', relative: true, offset: [-7, 0], });<\/script> &nbsp;&nbsp;Of course, as indicated above, if secondary meaning is required, then it must also be established before being eligible for a trademark.
