Applicant
An “applicant” for a patent may include: the inventor, all or fewer than all of the joint inventors, the person to whom the invention is under an obligation of assignment to or who otherwise shows sufficient proprietary interest, and a legal representative for an inventor that is deceased or under legal incapacity.[1]See, e.g., MPEP § 605.01. An applicant for a patent may file and prosecute their own case. Alternatively, the applicant may give power of attorney so as to be represented by one or more patent practitioners or joint inventors. A juristic entity (e.g., organizational assignee) must be represented by a patent practitioner even if the juristic entity is the applicant.[2]See, e.g., MPEP § 401.
